Terms of Service
By accessing and using 4F Studios' website and/or any games made available by 4F Studios, you agree to the following terms and conditions. If you do not agree with these terms and conditions, do not use the website or the games.
All laws and regulations applicable to interstate commerce, these terms and conditions, and all terms and conditions of any agreement provided by any third party provider apply to 4fstudios.com, any games and/or apps licensed to customers by 4F Studios, and/or any affiliate or subsidiary of 4F Studios, via the Site or third-party providers.
When you register to access and use the 4F Studios ®(by X3M Labs) and services, we require your express acceptance to these terms and conditions and the privacy policy. You may not register for access to the Services or use them if you do not agree to be bound by their terms and conditions or privacy policy.
1. License
You are hereby granted a limited, non-exclusive, non-transferable, non-sublicensable license by 4F Studios to access, view, download, and use the Site, the Services, and the Games solely for your personal and non-commercial purposes.
4F Studios may immediately terminate your access to the Site, any Services, and any Games offered in connection with either if 4F Studios determines, in its sole discretion, that your use violates any applicable law and/or otherwise violates these terms and conditions in any way.
No content from the Site or any Game may be copied, reproduced, republished, uploaded, posted, transmitted, or distributed in any way, with the exception of one copy that you may download and use for your own personal, non-commercial home use as long as all copyright and other proprietary notices are preserved.
Any game you download from a third-party vendor is subject to these terms and conditions.
All materials found on the Site, promoted on the Site, or made accessible through the Services are copyrighted and belong to 4F Studios or a supplier of 4F Studios. Except as permitted by these terms and conditions, no such materials may be used.
Any virtual items and/or currency offered by the Site, the Services, or as a component of any Game are given solely for your personal amusement and use as a part of using and enjoying the Site and/or any relevant Game or Games. You do not acquire ownership of any virtual goods or virtual currency; rather, you are granted a license to use them.
2. Code of conduct
When using the Site, Services, or Games, you must follow the Code of Conduct rules set forth by 4F Studios, which may include regulations for chat rooms, in-game messaging, and bulletin boards. The rules are not exhaustive, and 4F Studios reserves the right to take disciplinary action for conduct it deems unacceptable, including modifying usernames, terminating accounts, and canceling access to the Site, Services, or Games. The rules prohibit unacceptable online conduct such as using unauthorized third-party software, modifying files that are part of the Site or Game, facilitating unauthorized connections, using unauthorized software for gaming advantages, using the site for third-party promotion, or disrupting computers used to support the Site, Games, or Services. Additionally, there are rules for choosing usernames, which cannot belong to other people, use vulgar or insulting language, belong to celebrities or media personalities, contain trademarks or service marks belonging to third parties, relate to drugs, sex, alcohol, or criminal activity, or be offensive in any other way. Any use of the Site, Games, or Services deemed inappropriate or offensive may result in immediate account termination or suspension. 4F Studios will not intentionally disclose any personally identifying information about you to third parties, except where required to comply with the law or enforce these Terms of Service. Your user content, including your name, user name, and game or tournament records and winnings, may be used in accordance of the agreement. By using the Site, you agree to the terms of 4F Studios’s Privacy Policy.
3. User Conduct and Obligations
In consideration of your use of the Site, you agree to comply with the following conduct and obligations:
3.1. You will not engage in any conduct that could restrict or prevent any other User from using or enjoying the Site or any part thereof, or which could expose the 4F Studios, its affiliates, or any third-party service provider involved in providing the Site, to any liability or detriment of any type.
3.2. You will not use the Site to upload, publish, or otherwise transmit any Content that: (i) infringes or violates any intellectual property rights, publicity/privacy rights, or any other rights of any party; (ii) is defamatory, obscene, pornographic, vulgar, offensive, or unlawful; (iii) contains any viruses, worms, Trojan horses, or other harmful or disruptive elements; (iv) constitutes unsolicited or unauthorized advertising, promotional materials, spam, or any other form of solicitation; or (v) impersonates any person or entity or otherwise misrepresents your affiliation with a person or entity.
3.3. You will not use the Site to collect, harvest, or otherwise extract any information or data from the Site, including but not limited to Users' personal information, without their express consent.
3.4. You will not attempt to gain unauthorized access to any portion or feature of the Site or any other systems or networks connected to the Site, or to any of the services offered on or through the Site, by hacking, password mining, or any other illegitimate means.
3.5. You will not probe, scan, or test the vulnerability of the Site or any network connected to the Site, nor breach the security or authentication measures on the Site or any network connected to the Site.
3.6. You will not reverse look-up, trace, or seek to trace any information on any other User of or visitor to the Site.
3.7. You will not take any action that imposes an unreasonable or disproportionately large load on the infrastructure of the Site or the 4F Studios's systems or networks, or any systems or networks connected to the Site or the 4F Studios.
3.8. You will not use any device, software, or routine to interfere or attempt to interfere with the proper working of the Site, or any transaction being conducted on the Site, or with any other person's use of the Site.
3.9. You will not forge headers or otherwise manipulate identifiers in order to disguise the origin of any message or transmittal you send to the 4F Studios on or through the Site or any service offered on or through the Site.
3.10. You will not use the Site or any Content for any purpose that is unlawful or prohibited by these Terms, or to solicit the performance of any illegal activity or other activity which infringes the rights of the 4F Studios or others.
4. Termination
The 4F Studios may terminate your access to the Site and/or use of the Content, with or without cause or notice, which may result in the forfeiture and destruction of all information associated with your use of the Site. All provisions of these Terms that by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
5. Intellectual Property Rights
The Site and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof), are owned by the 4F Studios, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

6. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE 4F Studios AND 4F Studios’S REPRESENTATIVES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOOD-WILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SITE OR CONTENT; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SITE, INCLUDING WITHOUT LIMITATION, ANY DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF OTHER USERS OR THIRD PARTIES; (III) ANY CONTENT OBTAINED FROM THE SITE; OR (IV) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT. IN NO EVENT SHALL THE AGGREGATE LIABILITY OF THE 4F Studios AND THE 4F Studios’S REPRESENTATIVES, WHETHER IN CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE, WHETHER ACTIVE, PASSIVE OR IMPUTED), PRODUCT LIABILITY, STRICT LIABILITY OR OTHER THEORY, ARISING OUT OF OR RELATING TO THESE TERMS OR THE USE OF OR INABILITY TO USE THE SITE OR CONTENT EXCEED ANY COMPENSATION YOU PAY, IF ANY, TO THE 4F Studios FOR ACCESS TO OR USE OF THE SITE OR CONTENT.
THE 4F Studios AND 4F Studios’S REPRESENTATIVES WILL NOT BE LIABLE FOR ANY FAILURE OR DELAY IN PERFORMING UNDER THESE TERMS TO THE EXTENT THAT SUCH FAILURE OR DELAY IS CAUSED BY EVENTS BEYOND THE REASONABLE CONTROL OF THE 4F Studios OR 4F Studios’S REPRESENTATIVES, INCLUDING BUT NOT LIMITED TO ACTS OF GOD, WAR, TERRORISM, RIOTS, EMBARGOES, ACTS OF CIVIL OR MILITARY AUTHORITIES, FIRE, FLOODS, ACCIDENTS, NETWORK INFRASTRUCTURE FAILURES, STRIKES, OR SHORTAGES OF TRANSPORTATION FACILITIES, FUEL, ENERGY, LABOR OR MATERIALS.
7. Indemnification
You agree to indemnify, defend and hold harmless the 4F Studios and 4F Studios’s Representatives from and against any and all claims, damages, losses, liabilities, suits, actions, demands, proceedings (whether legal or administrative), and expenses (including, but not limited to, reasonable attorneys’ fees) threatened, asserted, or filed by a third party against the 4F Studios or 4F Studios’s Representatives arising out of or relating to (i) your use of the Site or Content; (ii) any breach or alleged breach by you of these Terms or applicable laws; or (iii) any act or omission committed by you.
8. Governing Law and Jurisdiction
These Terms and your use of the Site and Content shall be governed by and construed in accordance with the laws of the jurisdiction in which the 4F Studios operates, without giving effect to its conflicts of law principles.
Any dispute arising out of or related to your use of the Site or Content shall be brought in the state or federal courts located in the jurisdiction in which the 4F Studios operates, and you hereby waive any objection to the exclusive jurisdiction of such courts.
9. General
These Terms, together with our Privacy Policy and any other legal notices or additional terms and conditions or policies published by the 4F Studios on the Site, shall constitute the entire agreement between you and the 4F Studios concerning the Site and Content.
If any provision of these Terms is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms, which shall remain in full force and effect.
No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and the 4F Studios.

These Terms and Conditions may be revised from time to time by updating this posting. You are bound by any such revisions and should therefore periodically visit this page to review the then current Terms and Conditions to which you are bound.
